1. Introduction
Welcome to Friendly Shipping. These Terms & Conditions govern your use of our peer-to-peer shipping platform operated by Friendly Shipping B.V. from Amsterdam, the Netherlands. By accessing or using our services, you agree to be bound by these terms.
2. The Service
Friendly Shipping is a technology platform that connects people who need to send parcels (Senders) with travelers already going to the destination (Travelers). Friendly Shipping is not a carrier, courier, freight forwarder, broker or postal operator and does not provide transport services. We provide matching, identity verification (via Stripe Identity and other qualified providers) and payment processing infrastructure (via Stripe). All deliveries are arranged and carried out directly between users.
3. Eligibility
You must be at least 18 years old and able to enter into binding contracts. All users are required to complete identity verification before sending or carrying parcels.
4. User responsibilities
Senders are responsible for the legality, accuracy and safety of every parcel. Travelers are responsible for safe carriage and timely hand-off. Prohibited items include hazardous materials, illegal goods, counterfeit items, perishables and any items restricted by transport regulations.
5. Payments
Payments are securely processed and managed by Stripe, our payment provider. Friendly Shipping does not hold or control user funds at any time. Payment is captured at booking and released to the Traveler by Stripe upon successful QR-code hand-off confirmation by the recipient. Refunds and chargebacks are handled in accordance with Stripe's processes and our resolution policy.
6. Liability & role of the platform
Friendly Shipping is a technology platform that enables peer-to-peer hand-offs between independent users. We are not a carrier, courier, freight forwarder, broker or postal operator. The contract of carriage, when one exists, is established directly between the Sender and the Traveler. Friendly Shipping is not a party to that contract and does not take possession, custody or control of any parcel at any point. Users assume full responsibility for the shipment and its contents. To the maximum extent permitted by law, Friendly Shipping is not liable for any indirect, incidental, consequential, special or punitive damages, loss of profits, loss of data, business interruption, or any damages arising out of conduct of users, third parties, customs authorities, transport operators, payment providers, insurance providers or events outside our reasonable control.
7. Prohibited & restricted items
You may not send or carry: weapons, ammunition, explosives, flammable or hazardous materials; narcotics or controlled substances; counterfeit or stolen goods; live animals; human remains; cash, negotiable instruments or precious metals; perishable food without proper packaging; items requiring special licences or customs clearance the Sender has not arranged; and any item restricted by the laws of the origin, transit or destination country. The Sender warrants that every parcel complies with all applicable laws and is solely responsible for any breach. Friendly Shipping may inspect, refuse, hold or report to the relevant authorities any shipment suspected of violating these rules.
8. Customs, taxes & duties
For cross-border shipments the Sender is responsible for accurate declarations, applicable customs duties, VAT and any import or export restrictions. Friendly Shipping does not provide customs brokerage and is not responsible for delays, fines or seizures resulting from inaccurate declarations or non-compliance.
9. Insurance & loss or damage
Friendly Shipping does not act as an insurer or insurance intermediary and is not responsible for insurance terms, coverage decisions or claims. Optional coverage may be available through third-party insurance providers at the time of booking, subject to their own terms (declared value, item category, route, exclusions and claim process). Where coverage is offered, the contractual relationship is between the user and the third-party insurance provider. Users assume full responsibility for the shipment and its contents.
10. Disputes between users
If a dispute arises between a Sender, Traveler or recipient (e.g. delayed hand-off, alleged damage, contested QR confirmation), Friendly Shipping provides a structured resolution process: evidence intake, neutral review and a non-binding recommendation regarding the release of the payment held by Stripe. This process governs only the platform-mediated payment flow; it does not replace any rights you may have under applicable consumer or contract law and does not transfer liability for the shipment to Friendly Shipping.
11. Intermediary status & user content
Friendly Shipping operates as a hosting service provider in the meaning of the EU Digital Services Act (Regulation (EU) 2022/2065) and Directive 2000/31/EC. Listings, messages and user-generated content are provided by users; we do not pre-moderate them and have no general obligation to monitor. We act expeditiously upon valid notices of illegal content as required by law.
12. Account suspension & termination
We may suspend, restrict or terminate accounts for violations of these terms, fraudulent activity, regulatory requirements, repeated low ratings, or harm to other users. Where lawful and reasonable, we will provide notice and an opportunity to appeal. You may close your account at any time; certain data may be retained as required by law.
13. Force majeure
Friendly Shipping is not liable for any failure or delay caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, civil unrest, strikes, government actions, infrastructure failures, internet outages or third-party service disruptions.
14. Intellectual property
All software, designs, trademarks, logos and content provided by Friendly Shipping are the exclusive property of Friendly Shipping B.V. or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose. Reverse engineering, scraping, automated extraction and unauthorised commercial use are prohibited.
15. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via the platform or by email at least 15 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
16. Language & interpretation
These terms are available in multiple languages for convenience. In case of discrepancy between language versions, the English version prevails for legal interpretation, except where local law requires otherwise.
17. Governing law & jurisdiction
These terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Any dispute that cannot be resolved amicably or through the platform's resolution process shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands. Consumers may also rely on the mandatory protection of the law of their country of residence.
